Is it true that my spouse (currently on H4) with pending AOS if outside US when my (principal applicant) approval comes, will not be able to use H4. Will her H4 get invalidated the moment i become a permanent resident. What happens if she boards a plane and reaches US to find that her H4 is not valid ?

There is a quirk in the immigration laws that allows a person working for a cap-exempt employer to start working for a cap-subject employer once the petition is filed, even if the new H-1B status cannot start until 10/1/09. If the new employer files an LCA with a start date of 7/27, you should be able to work for that new employer under H-1B portability. However, if the new petition is denied, you lose your work authorization immediately.

The latest ICE outrage against immigrants has been released in a study conducted by Texas Appleseed, a public interest law center, and Akin Gump, a corporate law firm, and documents ICE's mistreatment of mentally ill immigrants at every stage of the deportation process. http://nyti.ms/atZYsB.
The report is just the latest in a stream of countless stories of neglect, abuse, and deaths of detainees in ICE detention. They must demonstrate clear and forceful leadership if they want to succeed in implementing the priorities and reforms they announced months ago on enforcement. I am in 6th year of my H1B. It is expiring in Aug 2011.
Here are some details:
- My I-140 is approved with a priority date of Aug 2006 under EB2-India.
- I did not apply for I-485 so I do not have a EAD.
- My wife is also on H1B which expires in Aug 2012.
Here are my questions:
1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?
Chances are very high that your priority date will be current before Aug 2011.

It all depends when someone applies for the labor, if you had BS+ 5 yrs exp and then did MS +4 yrs if you apply your labor now you can claim MS+9 again the experience at the current employer is not counted.....

If individual have US degree (Bachelor of Science in Nursing) along with B. SC in Microbiology from Indian, 1 yr Medical Lab Technician Course and 18 months Lab Assistance experience. Individual is on H4 visa, based on above qualification would student eligible for H1B visa? Person does not have SSN so do not qualify to get RN license in CA state. My wife has MSc in Comp and has work experience of 2 yrs as a programmer in India. She came last year on F2 and applied for H1 this year but She didn't get selected in the lottery. Someone told her that she can apply for jobs in universities and they do H1 (no cap).
Can someone tell us that this is true? and also suggest us where else can she try looking for jobs? Are all the Not-for-Profit organizations same in terms of doing H1 (no cap)?
I appreciate any suggestions and thanks in advance.

the pay is less but jobs is more stable and the university will file the visa paperwork(no lawyers fees)

We have immigration matters that needs to be updated but we don't know what we should do?
The following are affected
1. EAD

3. AP
4. I 485 related things.

Hi all,
I currently working in California and planning to move to Texas. Our company does not have a office in Texas .. so I will be working from home for the same company.
My I-140 is approved and 485 is pending for more than 180 days.
while AC-21 allows for changing employers with a different geographical location, is it OK to work for the same employer who does not have an office in a different geographical location?
Also, can we do H1B extension in this case? Any idea what my employer should show in this case if I work from home.

My mother-in-law is on a visitor visa. She is supposed to go to india in 10 days. But she had a medical emergency and had a surgery this week. She cannot travel to india right now, as she needs rest after surgery. I have filled 485 on July 2nd. I have received receipts on Aug22 but my son 485 got rejected due to checks are not signed(my lawyer forgot to sign). CIS told me they sent back the 485 packet to my lawyer, but my lawyer is saying he did not received. On line status/ CIS officer told me to re-submit the file.
I am trying to re-file. Is any body faced this type of problem? Did USCIS accepted the file? Whom should i send this file or is there specific person like "Supervisor" or "Manager"
My lawyer is not supporting, he is giving hard time.
I am waiting for your valuable response.

I just received a NOID for my 485(No LUD on the online status, received direct mail) saying that my underlying 140 is withdrawn and AC21 not filed. I have filed for AC21 last june (yes June 2009) along with my RFE (asking for G325a, Medical, Birth Certificate and 10th marksheet - this was during the Pre-adjudication time). My 140 was withdrawn by my employer as I had changed jobs under AC21 provisions(left employer in Jan 2009, filed AC21 in June 2009 and 140 withdrawn Dec 2009). Guess I will send the entire paper work again. I am EB3 India with Feb 2004 PD and I am no where near being current so I am trying to figure out if it is just me or is this the new scam that USCIS found to harass us!!!
PS: My friend who is from the same employer, similar case (Nov 2003, EB3 with AC21 filed) also got a NOID. He responded to it yesterday. Guys, post here if you also received the same.

both father and mother attended visitors visa interview together at hyd counsulate. interview finished on February 18th 2010. no questions to mother in interview just all questions to father only and then said " you will get visa in 5 days " thats all.
Our father passport came with visa stamping on 26th itself that means counsulate gave that to vfs on 24th february.
still our mother passport is with counsulate of hyd only. they didnt give to VFS. i checked with vfs.

what to do , total 15 days (i.e; 10 working days ) over. in this above link they gave email id of counsulate. shall i send email to them . if i send email will that effect the mother visa stamping approval in any way like negative way. counsulate phone number also there but that is restricted for urgent/emergency purpose. is this will come under urgent/emergency ?
