fionaapple20: Safest and clean route is to find an another employer and transfer H1B. Make sure your current employer does not revoke your 140, in case if its not approved. Additionally, it is highly recommended to invoke AC21 after your 140 is approved and 180 days passed.

I had AOS though company A and holding my H1 which is expire in July 2010.
I was interviewed by financial client B for contract to hire postion. I already joining them on 31st March as consultant and at after 2 months end need to convert in fulltime. This job attracts me because of never thinked pay scale and benifits in my life. Company B has record that no one leave them in last 9 years. Or never they lay off anyone.
I told client B that I can work on EAD but HR Manager wants me to transfer my H1 in company B.
JOB work is not same, My AOS based on server administartor and in financial client I am goign to do desktop management.
Is this something right approch to transfer h1b? Will company A can create any problem for my GC process? I already passed 180 days for pending AOS. Another thing is my wife has already used her EAD from h1 and working as fulltime. she is my derivative applicant.

Unless it is an expired "conditional status" card, your legal status in the US in no way changes. Only the card expires and not your legal LPR status! I don't quite understand what your "mistake on birthday" comment is all about!
You are still a legal permanent resident and can apply for a job proving your eligibility with your Social Security card and valid drivers license/state ID.
Get a new card by filling out form I-90 with USCIS and pay the required fees.

Child Protection Act is based on I-140 timing. If by the time of applying for I-140 your son got 21 then no-chance, it's not applicable. If not then some calculation is needed.

It is a case to sign in native language...
Well, if you forgot to fill the native language thing but signed the form, you don't have to worry about anything. Although the form is incomplete, the officer has no way of knowing for sure that your native alphabet is other than English... You may or may not get an RFE on this later...

My wife graduated in December from an ADN program in the US. She passed her NCLEX last month and has been working as an RN since then. She is working on an EAD based on my 485 application.
I believe a GNM and B'sc (Nursing) will both work in the US (From my reading only 1 state South Dakota exclusively requires BSN), but for foreign qualified nurses in addition to the education they require minimum 1 yr clinical care experience before sitting for the exam. They also will need to be qualified as RN's by their respective state nursing board or counsil in India.
You should post your questions on this forum. It is very informative on various aspects of the Nursing profession

PD isn't current, but just check i-485 online status, showing "Document production or Oath Ceremony" (i.e., the last cycle).
There was indeed a soft LUD in June this year. After that nothing much else. Is there sth good coming along my way?

Don't rely on online status, take infopass and check it out. BTW, it is most likely a FP notice, not an approval.

I’m confused about using the EAD. Someone please clarify me….
I already received the EAD for me and my wife. Currently, I’m in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
•Can I be in H1b and still work another job as a part-time?
------ if the part time job is using a part time H1 only then you will be H1 and dependents in H4 using EAD meaning you lose H1/4
•If my wife wants to work using her EAD does it have any effect on her h4 status?
--- her status becomes AOS pending and H4 is gone
•If my wife loose her job during the use of her EAD what will be her status?
--- she will reamain AOS pending same as while using EAD
•I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?
---- you can be self-employed and have similar job description and LC
•I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?

I am working from home which is NJ on h1b and my company is based DC as my seat is located in DC and i connect remotely to my computer located in DC office , i have below question regarding the LCA and payroll
1. Which location i need to mentioned as primary ,home or where company located?
The LCA should list the job location as your home address.
2. Which state should the payroll runs where i live or where my seat is located?
It doesn't matter for immigration purposes.

It is outrageous that NSC is not churning out any post April 2004 approvals for EB2-I. Is any one is taking any actions?
What can be done?
If you meant India, there is one case @
- mytracker23 India EB2 PD 07/24/2004 approved on Aug 07
If you meant China, there are couple of cases @
- greencard1234 China EB2 PD 03/25/2005
- erlizhinian China EB2 PD 03/26/2005
- evereadyjoe China EB2 PD 11/24/2004
But one thing is for sure, NSC has more ROW cases processed/approved, TSC is primarily going/approving India.
